Legal Question in Criminal Law in Colorado
shoplifting-first offense
My fiance was caught trying to take something from a grocery store. She has never done anything like this or gotten into trouble before, and she was honest about it when they caught her. Is this the kind of thing she needs a lawyer for when she goes to court? Do they offer light or probationary-type punishment for a first offense case like this?

Re: shoplifting-first offense
Depending on where she goes to court may determine whether jail is possible. I would hope for better than probation. Sometimes the Prosecutor will offer what is called a deferred judgment and sentence where a person enters a guilty plea and if they remain out of trouble for a period of time, the court lets them withdraw the guilty plea and the charge is dismissed. It may be worthwhile getting an attorney.
