Legal Question in Criminal Law in Colorado
My son in the Army was drunk and left the scene after he punched the side of a cab; the police told him he would just get a ticket if he comes to the station. They also said he would have to go to court for drunken disorderly conduct. He hasn't gone down because no one spoke directly to him, just his wife. What shouldhe do?
1 Answer from Attorneys
It sounds as if the cops already made the decision to charge him; he can either go accept the summons or wait until they find him and arrest him - and the one option is much more pleasant than the other. Keep in mind, however, that even if he decides to go in to accept the summons the cops are under no obligation to just serve him a summons; they can still arrest him if they decide to.
Also, make sure he invokes his right to remain silent; nothing good can come from talking to them.
