Legal Question in Criminal Law in Colorado
My son lives in Fort Collins, Co. Back in February, 2011 an acquaintance of his who has had past trouble with the law stole my son's driver's license and was subsequently ticketed for public intoxication in Boulder, Co. Unfortunately my son was stopped for a traffic violation last week and the officer informed him that there was a bench warrant for his arrest for the Boulder incident. Upon talking to the Boulder PD we learned that my son needs to set up a meeting with the Boulder DA to attempt to straighten the issue out, and if possible, bring the actual perpetrator with him (won't happen). My question is this--if we go to the Boulder DA will my son be arrested for the bench warrant and would we need to post bail, obtain a public defender, and eventually go to court? If we pay the fine for the ticket does the public intoxication charge stay on his record? Thank you for your time.

Your son needs to appear in the proper court and get the arrest warrant quashed, then meet with the DA and figure out a resolution.
