can a diary retry be used as an admission of guilt?

Only if proper foundation can be made. Even then, there are many other questions, the answer to which may prevent the use of the diary entry.

Is it the diary of the person accused of the rape? How did they get diary? Lots of questions need to be asked and answered before it can be determined if the diary can be used. I have successfully fought a number of these battles and would be glad to help. Good luck.
