Statutory Rape
I'm 16 my girlfriend is 21, but we don't have sex, is it still considered statutory rape?

Whether using the Bill Clinton or Kenneth Starr definition of "have sex," your girlfriend would not be committing statutory rape. But until you are 17, stay away from the 26-year-olds.
If you're not having sex under anyone's definition, no, it isn't statutory rape or any sexual offense for someone of any age to look fondly on a child, presuming that child is clothed.
