You miss your chance to participate in one of the glories of the judicial system: to tell the truth, the whole truth, and nothing but the truth (or not).

If you are unavailable and have already made previous statements in a forum where the defendant had the opportunity to cross-examine you (such as at a preliminary hearing), those statements may be admitted as evidence in your absence.
