Legal Question in Criminal Law in Colorado

Suspended Sentence

One year ago I received a 2 year suspended sentence for 3rd assault and harassment/ Domestic Violence. I am nearing the end of the court ordered Anger Management classes with 1 year to go till my sentence is up. I am in the process of changing jobs and wanted to know how this will be listed if potential employers ask for a criminal background or if I need to obtain a security clearance.

thanks

Re: Suspended Sentence

It depends on your case.

Based on what you write, I think you were convicted and sentenced with jail time suspended. If that is so, then a conviction for 3rd Degree Assault and Harassment and DV will show up.

If you were given a deferred sentence, then the records will show that you were charged and if they look close that you pled guilty to the charges. At the end of the deferred sentence, if you followed the conditions, then the case will be dismissed and will show as an arrest and a dismissal. You would have to file to seal your records in order for this not to show up.

Note that if you were convicted, then you cannot seal your records.
