Legal Question in Criminal Law in Colorado

theft credit card

ok i never forged any signature and there is no evidence of the following. The police came to my work and said this was the last place that Suzy(not real name) used her credit card and said i used it last. Then a couple days later charges of up to 800 dollars were on her debit card sent my address. Are they going to search my house, or put out a warrant for my arrest. I have no criminal history and was wondering what you smart people think. This was in ararpahoe county as well, and im a little freaked out. what charges can be put on me.

Re: theft credit card

You don't have to forge a signature to commit theft of a credit card, or of things you buy with it; you can sign your own name, or sign it Minnie Mouse, and it is still theft. If there is no evidence you are unlikely to be charged with anything. If you are wrong, and there is evidence that points to you, you can be charged with felony theft.

A warrant could be issued to search your house for items purchased on the card, if there is probable cause to believe you purchased them.

Re: theft credit card

At this point, you could potentially be facing a number of ffelony charges, including fraudulent use of a credit card, fraud and theft. You should definately not speak to the police or allow them to search your house and get an attorney immediately to speak to the cops and find out what kind of evidence they have against you. Good luck.
