Theft less than 100.00
What is the max standard penality if convicted of theft of less than 100.00? In this case the accused is suspected of theft of less than 10.00.

A theft of less than $100 is a class 3 misdemeanor and can carry up to 6 months in jail and a $750 fine. A municipality has concurrent jurisdiction to charge shoplifting and the penalties vary with the community. Usually with a first offense, the worst you are looking at is to pay the money back and probation or community service. If you have been arrested a bunch of times, you can expect jail.
