Legal Question in Criminal Law in Colorado

Theft-Misdemeanor

With a summons for theft in the amount of less than $500, with one of the victims being the a public university, what can I expect on my court date? Is there anything I can do to defend myself in a manor that could get me out of my case?

The first thing you need to do is to come up with a defense (I didn't do it... I was somewhere else at the time... I may have done it, but did not intend to... ). What you can expect on your court date is an offered plea bargain from the deputy DA. Whatever defense you have, it does not count until trial before a jury. If you present it to anyone else before trial... they may appear to listen, but they are not listening.

If it's your first offense, you are likely to be offered a deferred sentence, with community service, meaning if you meet the conditions of the deferred, the case will be dismissed after (usually) nine months. Then you'd be "out of" your case, if that's what you mean.

If you mean defend yourself by pleading "not guilty," then "I didn't do it" is always a good start, especially if true. As a next step, it wouldn't hurt a bit to hire a lawyer.

Good luck.
