I have got a ticket for petty theft about seven months ago and i went to court for it and they gave me coummunity service and i had to take a class and they said that if i do all those things that they will take it off my recored and that i have to stay out of trouble for a whole year and i just got another ticket for shoplifting and i was just wordering is their anything that i can do so that this wont be on my background or if they would give me another chance and when the cop had did a backgroung check on me nothing had came up i was clear, and wondering when i got to court will it come up my other ticket for petty theft. And my back ground is clean or i think that the petty theft is still on thier but they had told me that they would take it off.
1 Answer from Attorneys
Whether or not "they" give you another chance is entirely up to "them." I suggest that you contact an attorney. I suggest you contact an attorney and try to either defend the new charge, or if you reach a plea, to make sure that the new plea's terms include not revoking the deferred sentence in the old case.
Along those lines, you need to do what you can to help your attorney get you to that point. Make sure you complete your classes and public service in a timely manner. Second, avoid picking up new charges. Third, prepay the civil penalty the store will ask for.
Finally, successfully completed deferred sentences do not "disappear" from your record. What happens is the court withdraws your guilty plea and dismisses the case. The fact you got charged, took a plea, and the that the case got dismissed pursuant to an agreement remains on your record UNLESS you successfully petition the court to expunge the record.
