Time to settle suit

A suit was drawn up against an insurance co. for an accident

in which the accused had no valid drivers licence. My Present lawyer has had case against accused insurance company(accused was ticketed) for 1 year and not forthcoming results. Is this time frame typical for this type suit?

Hello:

I am assuming facts in regards to you case, and in order to answer your question I need to be sure I am assuming the correct facts. If any of my assumptions are incorrect, please resend your question to me. I am assuming the following facts:

1. You received personal injuries in a motor vehicle accident and you hired an attorney to represent you.

2. The person that crashed into you had no driver's license.

3. Either the person that crashed into had insurance or you had uninsured motorist insurance.

4. The person that crashed into you was at-fault for the accident.

5. Your attorney is in the process of making a claim of negligence with the insurance company for your personal injuries.

Assuming all of these fact are applicable: The statute of limitations for negligence involving a motor vehicle accident is three years... in other words, the case must be filed in Court within this time or else the claim is forever barred. It often can take awhile to process and resolve a personal injury claim, and one year is not uncommon. I recommend that you call your attorney and ask him if he can provide any timetable for when your case might settle.
