Legal Question in Criminal Law in Colorado
Victim Statements given under the influence.
I am the victim in a case where I was not a victim. I was under the influence and out of it, I was also guided to give a false statement by police. My guy is being held in a felony case, where all he tried to do was protect me from myself. I take sinus med's and drink with them. The DA has yet to acknowledge the fact that I recanted my statement. What do we do?

Re: Victim Statements given under the influence.
Take your information to your boyfriend's attorney. If you were improperly interrogated by the police, the attorney will likely be successful in having the statement thrown out as evidence.
Also, you don't sound like a terrific witness for the prosecution. Such a handicap often leads to a dismissal.
Good luck.
