Legal Question in DUI Law in Colorado

3rd DUI .. I think..

I am needing some advice and help with what could be a very bad situation right now. I just got a DUI last nite in Colorado, that is where I live now. But a few years ago I got 2 in KS(one in 2000 and one in 2003) Do the ones in KS carry over to colorado. and what is the colorado law for DUI's.. particularly the third one. Also, I will do anything to avoid the jail time, as I will probably lose my job if I have to go to jail for 10 days. Are there programs / anything I can do.

Your prior DUI convictions certainly carry over to Colorado, and the court and the district attorney will have access to them.

So you're right, you are in a very bad situation right now.

If you are convicted, by statute the judge will be able to suspend, at the most, 80 days of a minimum 90 days in jail. That's the BEST you can hope for. And if you've already done Level I and Levl II alcohol programs, as I suspect you have, the judge may well send you to jail for a year.

I'm guessing you know this already, because you already know about the 10 days the judges have at their discretion.

So your key to not spending 10 days to a year in jail, and losing your job, is not to be convicted of DUI for the third time.

To have any hope in hell of achieving that, my guess is that you could use a lawyer.
