Can I be charged for a DUI
I was a a friends party and a off duty police officer was there. He observed me drinking and commented on whether or not I was driving home or not. I did drive home and was fine. Can I still be charged just by his observation?

No. Relax; have a drink. But don't drive after.

yes you can, but did he actually see you drive? IF not, then likely not enough evidence to get past a corpus delecti motion. Also, his observation is weak evidence of intoxication or impairment.
