Is a Colorado dwai considered an criminal offense in Illinois?

I am preparing to fill out an employment application which asks: ''Have you ever been convicted of a violation of the law--name removed--any civil, criminal or military court?''

In 1995 I got a dwai (.08 offense) and wanted to know if this qualifies as a ''violation'' as termed in the question above. I am applying for a job in Illinois, where dwai offenses do not exist.

I want to--name removed--honest in my application, but would prefer to exclude this embarassment, if possible. I know the company runs a background check and wanted to know if this would still show-up and whether it would--name removed--considered an offense.

Depending on what agency the company uses to check backgrounds, it is highly possible they will find out this information. I would suggest you be honest and explain the circumstances surrounding the incident. DWAI is simply given a different name in Illinois - DUI.

I assume and conclude from your email that "dwai" is the same as what lay people term "Drunk Driving". Yes, this is a criminal offense in Illinois, just as it appears to be in Colorado.
