What can I do if I went to court and they did not have the paperwork done or charges filed? Its been 10 days since my arrest.They told me to come back in 1 week.

You can ask the Judge to dismiss the charges. Generally, some Judges will dismiss without prejudice while others may grant the DA additional reasonable time. If the DA can articulate specific reasons for not filing charges and convinces the Judge that with reasonable additional time charges will be filed then the Judge will grant additional time to the DA. However, the DA can refile with the statute of limitations which is, generally, 18 months for misdemeanors and 3 years for felonies. Some exceptions apply which is based on the specific type of crimes.
