Legal Question in DUI Law in Colorado

D.A. Deal denied by judge

My boyfriend is going thru his 3rd dui case (20+ yrs). The D.A. offered home arrest, the Judge told him to prepare for jail time. Why? He is doing all of his classes, alcohal related along with Antabuse, AA etc. He has not even been required to do this, but knows it's coming. His lawyer told him to prepare for jail? This is an Adams county judge, female, who is supposedly really tough on DUI. What can we do? Is it really up to the Judge if the D.A. offers something different?
