How to get a drivers license back after 3 1/2 years w/o court date

If a person gets into an accident while driving under the influence & does not have a current license (but is eligible for one), does not go to court for the incident (through granted extentions), and waits three and a half years, may the courts see this 3 1/2 year period as ''time served'' or will they issue a revocation period from time of hearing? Through miscommunication, this person now has a Bench Warrant. What are the possibilities for sentencing?

In Wisconsin, you will be administrately suspended for 6 months by the DMV 30 days after the incident. Your bigger problem is clearing the warrant then dealing with underlying charge. Your success there will, of course, depend on the facts -- which were not described. If convicted, the court will then suspend or revoke depending on the number of priors -- again not described. You would get credit for the time you were suspended and would likely be eligible for an occupational licence that would restrict your hours but allow you to travel to and from work.

The answer for Colorado is that Motor Vehicle controls the revocation period, not the Court. If you have not been driving, you will get credit. In court, it will depend on how many priors you have.
