You must immediately request a hearing with the DMV regarding your license. If you do not request a hearing within 7 days of your license being revoked, you will lose the issue. To beat your DUI, there are a variety of ways to challenge it, but it's hard to say how you would challenge it without knowing more about your case. As to the license, if your breath was over .08 or you refused, then the police took your license already and gave you a notice of revocation. Go to the DMV and request a hearing ASAP (must be done within 7 days) and do not request the cop.

If you took a blood test, you likely do not know about the results yet (takes about 3-4 weeks for notice of revocation to be mailed). Once you get a notice of revocation in the mail, go to DMV by the date on the letter or ASAP (same 7 day rule) and request a hearing.

If you do not req a hearing, you lose the issue.
