This is something you can try to prove to the DA and get them to dismiss or give a deal. Or, you can try to case to a jury and present evidence of the defense and ask them to find you not guilty.

Basically, in a prescribed medication situation, you need to show that you were unaware of the affect or that this affect was unusual and so you could not have known.
