You're more likely to be arrested for failing a spelling test.

There is no point level for DWAI: you can be .02, and if you're impaired, you can be arrested. For DUI it's .08.

Hello there,

To be found guilty of Driving While Intoxicated the state must prove that you have lost the normal use of your mental and physical faculties by the introduction of alcohol, a drug, a dangerous drug or a combination thereof or have a blood alcohol concentration level above .08.

If you had a level below the limit and look OK on the field sobriety tests you should have a fighting chance. If you are stumbling around and look as if you have lost the normal use of your mental faculties a jury could convict you.

You need to contact an attorney in your area that focus their practice on the defending individuals accused of driving while intoxicated.

Sincerely,

Erick Platten
