DUI UNDER 21 (2 within six months)
Im 18 and got a DUI in August because I was at a gas station in a physical confrontation with someone who was actually driving my car. The police were called, they showed up, and I for some reason said I was driving. I have statements from several witnesses(incl. the driver) that I was not driving. The second happend weeks later, where I was driving, and is legitimate. I am fighting the cases as we stacked them to be on the same court date. 1. Do I have the option to try the case where I am innocent first? Which would you recomend to go first? Could they impose a more strict penalty on the second as I turned down the plea agreement?(plea agreement was 5 days in jail for second, 18 months deffered on 1st, with Alc. classes and community service) Help! Court is coming up! Also, can he get a DUI now as they didnt see me driving and I admitted it, and they didnt see him driving, and he will admit it in court.

For goodness sake don't ask your question here. Ask a lawyer who you retain and retain immediately. Anytime you're facing jail, you need a lawyer. If you cannot afford one (are indigent), apply for a free lawyer at the Public Defender's office. Those guys and gals are good, among the best in the nation. Use them.
