Legal Question in DUI Law in Colorado

DUI for Rx-out of state

My husband got a DUI with a minor accident he had while driving in WA. But, he has a CO Restricted driver's license(from an early reinstatement there that was satisfied). If he does not appear if and when the charges are filed in WA, will CO take his license back? He does not have a WA license. We were just planning on moving to the East coast to be near family. Is this going to prevent him from ever getting a license again if he fails to appear in WA?

Re: DUI for Rx-out of state

Both Washingtonand Colorado belong tothe Interstate Compact on Driver's Licenses, an interstate agreement where one state will notify another of out of state people who fail to show up for court or comply with court requirements. No matter where you go, this matter will have to be taken care of eventually. As someone with 25 years experience in DUI and traffic law, with extensive courtroom experience, I can tell you that you need to get a good lawyer who deals extensively with this type of case, Good Luck!

Most likely it will keep your husband's driver's license suspended no matter where you move. In the old days, even 5 years ago, states communicated with each other very little. However, as more information has become computerized and networked that sharing has increased. Your husband should retain an attorney who practices in the court where his case was filed. A good attorney should be able to work out the details of your husband's case so that he only appears once. Contact me directly if you'd like further assistance.
