DUI without test, how can that be?

This is for my sister. She was arrested on the 29th of Sept. The charge was driving under revocation. Then charges of careless driving were added along with no Insurance. But the one that makes no sense is the DUI, she was charged with this after being in the Jail for 6 hours, no breath, no urine,no blood. How can that hold water. She needs an experienced lawyer in the metro area. The reason for no insurance is because of the unconstutionally credit score driven Insurance payments. Just because your credit score is not great does not mean your more of a danger on the road. I would like to the research that derived that. She is not be any means rich so please keep that in mind. She knows the price of justice is high. She justs wants to some of it, Justice for this reeks of harrassment and discrimination.

There are many ways that a person gets charged with DUI without any actual breath or blood tests, but certainly the strength of the case can be seriously questioned depending on how they do it. Was there an accident? If so, possibly other driver, cop noted odor of alcohol. But that would likely result in blood/breath tests. Possibly they are charging her on a theory of driving under the influence of drugs. Again they would usually want a urine test for this, but I've seen it without any tests. Were roadside tests given? If so, they could possibly base a charge on the observations there. Another possibility is that they claim that your sister refused any tests. Those are some thoughts on how that might happen.
