Legal Question in DUI Law in Colorado

DWAI, acid reflux and ADD

Can acid reflux interfer with the reading on a breathilizer?

Can a person (first) be evaluated with a AAO x3 by parametics and 3 hours later taken into custody for a breathilizer reading of .10?

Attention Deficit Disorder (ADD) is not an uncommon disorder, if this condiction is made known to the parole officer and class instructor should something be worked out to help the offender complete the courts requirements.

Thank you

Re: DWAI, acid reflux and ADD

Acid reflux will affect breath test. The 3 hour delay between driving and breath test affects its value for determining DUI/DWAI bc difficult to say what BAC was at time of driving.

All of these things are important to a DUI/DWAI case. Call or email if you want more information.
