Legal Question in DUI Law in Colorado

I was received a DWAI in the state of Colorado and had my license suspended. On June 15th I was allowed to get my license back. I failed to get this done in time and unfortunately was pulled over. I was arrested and my bond set at 10,500. I paid the bondsman and have a hearing in January. My question is shouldn't I have been given a ticket for driving without a license instead of a revoked, since I was able to get my license back? I had gone to the DMV and they had given me a license number I just had to send in the $95.00 to get it back.

according to statute, until you fully reinstate, you are DUR-Alc.

But, most prosecutors will plea this to a non-driving offense if you have your DL reinstated when you go to court

No. Technically you are under revocation until you get your license. It may be possible to get the charges reduced so you can get your license and stay out of jail.

When a license is revoked, it remains revoked until you are reinstated, with a new license.

Get your license, bring it to your hearing, and you may get the charge dismissed, or at least reduced to a non-moving violation. If you plead guilty to a moving violation, it will re-revoke your license.
