Legal Question in DUI Law in Colorado

Dwi ticket

the person who received the dui was not driving when he received the ticket-he was given a ride to where his friend and truck was at. He states the offices added and exagerated what really happen on the report. He feels the courts will believe the report no matter what is true or what he says. He had asked for his keys to go get his cell phone and coat from his truck because his friend was arguing with other friends and this is when he went to his truck to walk away from them. What do you suggest?

I have fought and won these types of cases. This is why we have a jury system. I have had DA's dismiss these types of cases in the right circumstance. Officers often misconstrue or write the reports poorly.

if you have not requested a DMV hearing and it is within 7 days of arrest, go to DMV and request hearing immediately (no cop)

These are cases where witnesses can make or break your case. I won a similar case at trial a while ago where the DA simply refused to believe witness statements that my client never drove. What county are you in? I would get full witness statements attesting that you did not drive before court and DMV. I normally use a private investgator for this task since the DAs give more credibility to reports from licensed investigators. Give me a call if you need help.
