Legal Question in DUI Law in Colorado

Speeding and Drunk Driving

I recently received a ticket for Driving while under the influence, driving while extensive alcohol on breath and speeding (120 mph). I coach, go to school and need to work, what should I expect from the courts. And will the DMV possibly allow me to have a red license.

Re: Speeding and Drunk Driving

Sounds like you were stopped for speeding, took a breath test that was over .08. If this is your first DUI type offense with an Expressed Consent revocation, you are looking at a 3 month suspension of license. There is an option to have a 1 month suspension followed by 5 months of probationary license. Unless you win the DMV hearing, you will have to serve some sort of full suspension. If this is not your first, you could get a 1 year suspension.

DMV hearings can be won. I have won many.

The criminal case will not lead to further suspension unless you plea to a DUI or a total of 12 points. A speeding ticket of that nature would get your there.

I highly suggest you hire an attorney that primarily deals with DUI cases to help you. It is too difficult for the untrained.

I would be pleased to represent you if you want. Please contact me.

You need to request a DMV Expressed Consent hearing within 7 days of notice of revocation. If this was a breath test, then the notice was given to you when you were arrested. Do not request the presence of the police officer - if we want him/her there, we can do that later. Most often, we do not want the officer there. You request a hearing by going to your local DMV office, tell them you were arrest for DUI and that you want an EC hearing. They will walk you through the rest.

What was the BAC number?
