can someone talk to me about 42-4-1301(1)(a)
and 42-4-1402(1), with refusal of test, no arrest, wreck into a house. Insurance for personal property damage and no prior arrest for dui or dwai! Does anyone know if my hubby will go to jail for sure?

if no injury, likely no jail, but it depends on jurisdiction - what county is this case?
why no arrest? did H go to hospital? was there a request for a test?
