Legal Question in DUI Law in Colorado

Ticket Vacancy

The arresting Officer put the wrong year on my ticket. When I went to court my name was not on the docket so I went to the front desk at the court house and the lady informed me there was a vacancy put out on my ticket because the officer put the wrong date on my ticket. she told me that the officer could track me down and write another ticket for me. how long does she have to write me a ticket before i am let off or is there a time frame on this?

Re: Ticket Vacancy

Hello:

The statute of limitations in this case regarding a class 1 or 2 traffic misdemeanor is one year. The officer must reissue the ticket within this time period, or else the charge is forever barred (providing that you do not move out of state, or otherwise the statute of limitations is tolled). I hope this answer helps you. David Colt
