Legal Question in DUI Law in Colorado

First time DUI Charge

I was pulled over for a brake light being out, I was asked if I had something to drink I replied yes. I was given field test and portable breathe. I was arrested for DUI and blew a .089 at the station I requested a blood test at first but the officer said I would not be able to see a judge until Monday and was stopped on Sat night. I opted for the breathe test and I am very unsure about the outcome. I requested a hearing and in the advise of an attorney have the officer present. Did I do the wrong thing? Any advise as to where to go from here would be appreciated.

Thanks

Re: First time DUI Charge

If you have an attorney, you need to consult with him or her.

I prefer my clients do not request the officer's presence at the dmv hearing. I do not know of any attorney that wants to make that decision prior to reading the reports.

You have a winning issue if you requested a blood test and the officer talked you into a breath test. This can allow you to keep your drivers' license and may suppress the test results in Court. You need to consult with an attorney that primarily handles DUI cases.

I would be pleased to work on your case. Please contact me if you are interested.
