Legal Question in Education Law in Colorado
Education
Can a college in Colorado require third party documentation to excuse a student's absence for religious observance? The student notified the teacher of his absence for religous holidays, but the instructor would not let him make up a missed test without a note from his rabbi.

Re: Education
Interesting question. I have been a professor for 40 years and never required an "excuse" for religious attendance. Our university does permit an instructor to demand proof of absence due to medical conditions. I would think the professor does have a right to ask for proof of religious attendance; however, a professor cannot discriminate based on the "content" of the religion. I.e., he/she must demand proof of all others missing exams or classes due to religious reasons.
