Quick Deed and Medicaid
My family did a quick deed on my parents home when Mom went into a Nursing Facility. This put the house in just my fathers name. When the house was sold and my father died, medicaid told us Mom no longer qualified for medicaid.
Is this true? Money from the sale of the house was willed to us three children by my Dad's will.
Please advise.
Thank you.

Re: Quick Deed and Medicaid
One cannot disinherite one's spouse under Colorado law. Your mother would be entitled to a certain percentage of your father's estate. If he willed everyting to the children, Medicaid will have a problem with that. I recommend that you contact an Elder Law attorney right away to review your options.
