Legal Question in Family Law in Colorado
2 contempts w/grounds and now motion for sole custody
when i got divorced in 97 my ex husband agreed for me to have sole custody. he barely ever showed up for parenting time and barely ever paid child support. currently he owes about 27,000.00 in arrear child support. he left the city on numerous occations for years at a time. he filed a contempt in 2002 saying i dont let him see our kids and the court decided on supervised parenting time through a counselor, then casa and then casa drop off. after a few visits he disapeared again and then showed up again at my daughters bus stop, etc. he once again 2 years later filed another contempt for visitation and the judge dismissed it for the second time. now i found out that my ex file a motion for sole custody because i abuse my kids. i'm a very good parent, active in their school and church activities, been there all these years for my kids when they were sick or when there was problems. my kids see a counselor, a physician that prescripes meds to my son, i call/e-mail their schools to check on them. he has a criminal record for drugs, etc., has a bad temper, has a common in law wife with a 6 year old and another small child which i believe
i think he is crazy........but ya never know.......what chances does he have to get sole custody?

Thank you for contacting us with your legal question. My name is Hollie Hinton and I am an attorney here at The Harris Law Firm, P.C.
Based on your description of the facts, your husband's chance of getting sole custody is slim. He has a really high burden of proof that the change in custody is in the children's best interests.
This is a case where a child and family investigator would be appropriate. You should definitely request that the court appoint one.
However, if you need further assistance, please feel free to contact us. We offer an initial 45-minute consultation at $150. Our firm dedicates its practice to family law, such as this one, and would be happy to assist you in this matter.
Thank you again for your question.
