Legal Question in Family Law in Colorado

Alimony

I pay alimony to my ex-wife every month. In our divorce, she was ordered to pay outstanding medical bills pertaining to herself and her children. These are affecting my credit in an adverse way and I want them paid. Can I pay them and legally deduct the payment from her monthly alimony payment?

Re: Alimony

Technically, it's legally improper to pay the bills and then deduct the amount from your alimony checks. However, you should check your final orders for an "indemnification" clause which basically states that if you have to pay something she should have paid, you can request reimbursement from her. If that's not in your agreement, you could pursue a contempt against her for failing to pay or to use as leverage to get her to pay.

Hope this helps!
