Legal Question in Family Law in Colorado
Annulment of Step-parent adoption
My son was adopted by my soon to be ex-husband about a year ago. His birth father was in jail and behind in child support so he reliquished his rights. Now that I'm getting divorced, the birth father has cleaned up his life and is wondering if there is a way to annul the adoption and be the father again. The step-father would probably agree to the annulment. Is this possible?

Re: Annulment of Step-parent adoption
I am not aware of any such thing as an annulment of an adoption. I believe you would have to go through the adoption process again in order to reverse it.
Please think long and hard before going along with doing anything like this. The Courts favor stability for the children. The Court could choose to deny the adoption petition this time. That risk will get higher each time he (or you) tries this.
Adoption is intended to be a forever thing, not something that changes from time to time.
If you, your soon-to-be ex and your ex can work together, you can arrange for the birth father to have an active role in the parenting of the child without changing legal relationships.
