Legal Question in Family Law in Colorado

Bigamy and marriage of 40 years

My husband was previosly married for a short time. He left her in Colorado after finding her in adultry and returned to Indiana. 15 months later,he was sued for child support on a month old baby. This was in '57. He thought it was for divorce also. The judge dropped the case in '58 ,said there was more evidnce to prove he was not the father, than that he was, said that he owed no back or future child support. It was noted again in'61. Why? His lawyer said that when the support case was over,he would be divorced. He was paid 150.00 for a divorce. No records are here about divorce, only support case. We wed in '60. The ex remarried some time, died last year. No contact made sense separation.

Saw a lawyer ,asked if we are married, are our children legal. He said we have a legal marriage licence, but my spouse was a criminal,a bigamist, but that ceased when exwife died,we have always been legaly married .I feel he was easing our pain. He is searching further Ind. and in Co.

Are we legaly married, all of this time, are our children legal, am I a wife by default,as she died? Can my spouse go to jail for bigamy? We have not heard from the lawyer for 3weeks,should we call him?

If you have a lawyer who knows all the facts of the case and has given you his opinion, I would defer to that and not try to second-guess him myself.

If you have concerns, certainly call him and ask for an update.

Best of luck to you. Sounds like a tough situation.
