Child Abandonment

My son's father hasn't been around or made any contact in almost 3 years, it'll be 3 years in April 2008. I recently got engaged and my fiance has been talking about adopting my son. Do I need to talk to my son's father and see if he will terminate his right or has he involuntarily terminated his rights?

You will still have to formally terminate the father's rights. It would be best to start by talking him to see if he will voluntarily give up his rights. If he has not been paying child support, the realization that you can ask for child support now, but not after he has given up his rights and the child has been adopted may be persuasive.

If he refuses to give up his rights voluntarily, you can ask the court to terminate his rights based on abandonment of the child. From what you have said here, it sounds like you may have a good case for convincing the court to do so.
