How can a child custody agreement be changed once both parents have moved out of the state where the divorce occured? The childrens mother moved out of the state and wanted to split the kids up six months at a time. Their father felt this was not in the kids best interest and agreed to move so the current agreement could be honored. Once both parties had moved to Indiana the kids mom decided to get remarried and move to Ohio and take only one of the children. Their father has not agreed to this and has been deceived by the mother and needs to decide on the best course of action, whether that be to get full custody or to go back to Colorado and let her be in breach of the original decree.

The most reasonable course of action is to register a certified copy of the Colorado decree in Indiana (or Ohio) and file a petition to enforce the decree or modify it, including the information required as to where the children have resided for the past 5 years.
