Child Custody

I want to move to Colorado in the spring. I want to take my child with me. Can I file for custody when I get there so I will not be tied up in the Virginia court system? Can my child's father stop me from leaving the state of VA and moving out to CO?

Your husband cannot stop you from going to Colorado yourself but he can prevent you from removing the child to Colorado with a Virginia court order. If you take the child to Colorado before your husband

obtains a Virginia order to prevent that action, and you then file for custody in Colorado, then that state will be the jurisdiction which ultimately determines the custody issue.
