Legal Question in Family Law in Colorado

Child Support Calculations

CO - Order

AZ - Other Parent

Is the Child Support calculated different if the AZ Parent is on Welfare/State assistance and owes a lot of arrearage to the CO Parent?

Or do the standard CO calculation stand ground?

Re: Child Support Calculations

Regardless of where the other parent lives, if the case is lodged in Colorado, the guidelines control. However, the guidelines provide for a minimum child support amount when a person is on public assistance.

The amount of arrearage is not used in determining a current child support amount. However, the Court will usually order the other parent to make some payment toward the arrearage, though that might be $0 for the length of time the other parent is on public assistance.
