Legal Question in Family Law in Colorado
Child Support and Custody
I understand that these are two different cases. But my daughters father has not seen her in 2 years do to him being on probation. WE had two procetction orders on him for trying to hit us with his car. What are the chances of him gaining any kind of custody of her in the near future? Everything with his probation was finalized in March 2008. He has not tried to contact her since before the incedent in May of 2006.

Re: Child Support and Custody
He is not at all likely to be able to have any substantial parenting time anytime soon. If the protection order is permanent, then he will have to modify it before he can see your daughter. If the protection order expired with his probation, then he will have to petition the court for parenting time. Under such circumstances, I would be surprised if he could get more than supervised parenting time, at least initially. In this kind of case it is generally a long and slow process of increasing incremental parenting time while everyone rebuilds trust and the offender proves he is safe to be around the child again.
