My ex-husband was supposed to pay child support until our daughter turned 19. She started college ion August 19,2007. She turned 19 Feb.21, 2008. Her father stopped paying child support as of Aug. 19th, paying only half a months child support for august with no discussion other than when I called him he said, as she was in school and had ''moved out'' to live in a dorm, he didn't have to pay me. I would have used the money anyway to pay for my part of school expense for her. I feel I have contributed the thousand dollars a month in that he didn't pay me. He said that ''since I didn't contribute to her living expensesI cannot take the deduction on my taxes. I never raised my child support in all the years I was divorced, 12 years. I did not agree to not recieve my child support, did he have to pay it and can I go after it now?

When the child goes to college, it can become a gray area. However, generally speaking, he was obligated to pay it anyway. You are entitled to file a motion with the court to ask that he show why he should not be held in contempt for failing to pay those last few months.
