Legal Question in Family Law in Colorado

Child Support Modifications

I use the local Child Support agency to collect child support from my ex-husband. I recently try to increase my support for medical expenses like monthly co-pays, monthly med co-pays, medical and dental premiums and braces. My ex didnt agree and now we have to go to court. I also have expenses that are not monthly but they add up over time.

Is it possible for me in the next court hearing to ask the judge to make my ex pay me half of all the other expenses (other medical co-pays, glasses, surgery co-pays, things needed for glasses/contacts, things needed for braces, other med co-pays) like once a year?

And if so can i collect thru the child support agency since my ex already getting his wages garnished?

Re: Child Support Modifications

Extraordinary medical expenses which are not covered by insurance can be included in the child support calculation. An extraordinary medical expense(s) are the expenses in excess of $250 per child per year. You'll want to make sure you've got documentation of the expenses in order that they get figured into the new child support calculation. Once the new child support amount is calculated, the new amount can be garnished from his employer, including the amounts to be used for medical expenses (although the amount garnished will be the same each month based on the evidence presented at your upcoming hearing).

Hope this helps!
