Common Law Divorce

I have a sister who is looking at getting married. The problem is that her soon to be husband was common law married for the purpose of getting discounts on vehical insurance, etc. He also has a son from this common law marriage. Does he have to get a legal divorce (possible even go through custody or child support hearings) before they will be able to get married?
