Common Law Marriage

I live in Colorado. In 1999 my fiancee and I returned to Illinois to get married. My fiancee decided to mail the marriage license in himself. I called two months later to get a copy and found that the court never received it. We decided to do nothing about it and continued to live together. We have since separated and wanted it to remain amicable however, I need to know if we should get a formal divorce. We did live as though we were married and others thought so because we had a ceremony. Do we need to get a divorce or can we just split up if we both agree to?

You will probably want to get a divorce to protect yourself from any claim he might make later to any assets you acquired during the time you were together and also to be certain he could not nulify any future marriage.
