Legal Question in Family Law in Colorado

County lost Marriage registration

After 20 years of ''Being Married'' The Irs informed me my social security is still in my maiden name. When I checked for the record ofmy marriage, Montrose County says it was never registered! I have a letter from the Minister who performed the ceremony stating he did have it properly registered.

What do I do in the case of the lost licence! I have proof of the ceremony and signing of the licence, but if the record is lost does it mean We are not married? What happens in the case of a death or other legal matter? All our documents are in my married name.

The county clerks secretary says their Lawyer told them all they can do is send me a copy of the ''application'' for a marriage licence that they miraculously found (after I wrote a letter to the county clerk and recorder)they previously said they couldn't find. And had searched several times. Also that their lawyer would not give me any advice on what to do.

What do I need to do?

Re: County lost Marriage registration

Common law marriage is generally indicated by telling people you are married, filing taxes together and putting one or the other of you on the other's health insurance. The minister's letter is another good indicator of your marriage, as would the application for a marriage license. It would probably be difficult to prove you are not married.
