Legal Question in Family Law in Colorado

My daughter's boyfriend's farther died and step mom received 50,000 dollars from his 401k. His will stated that the 50,000 be split 3 ways with the kids. Step mom is keeping the money .

Who was listed as the beneficiary when the 401k was set up? That trumps the will. It was probably the step-mom or she wouldn't be holding the money. Sorry.
