Legal Question in Family Law in Colorado

dispute with ex-wife

What is my recourse to stop my ex from having my 9 yr old twins dropped off by the school bus at her empty property? In their first week of school she was late arriving to the property and the girls were left alone near a dirt road in an undeveloped area. We share 50/50 custody, but live in different states. In previous disputes with her involving the kids, she has told me that when she has custody, ''they are of no concern of mine''.

Re: dispute with ex-wife

If the case is in Colorado, you can file a motion with the Court to modify the parenting time if you can show that the present arrangement is endangering the lives and/or health of your children. If it is as deserted as you describe, you may very well be able to meet that standard. You can file it as an emergency motion.

If the case is not yet in Colorado, you might be able to get a temporary emergency order, but would have to fight the issue in the state where the case is at in order to get a permanent change.

The children definitely should remain a "concern" of yours, no matter whose care they are in. You can still be held accountable for harm to them in many situations if you are aware of the potential danger and do nothing.
